TIM: COURT OF MILAN REJECTS THE APPLICATION FOR INTERIM RELIEF FILED
BY INWIT
Lawfulness of the withdrawal from the MSA confirmed
TIM, with reference to today’s press reports, confirms that the Court of Milan has rejected the application for interim relief filed by INWIT , confirming the lawfulness of the Group’s withdrawal from the Master Service Agreement (MSA).
In particular, in the order filed today, the judge found that the conditions for granting the interim measures sought by INWIT were not met, both in terms of admissibility and with respect to the requirements for such a decision.
Furthermore, the judge ruled out both the existence of grounds for urgency and the conditions required to establish that TIM had abused its position of economic dependence over INWIT .
The Company expresses its satisfaction and is confident in a swift resolution of a matter in which it has consistently maintained that it acted properly and in full compliance with the contractual agreements.
