INWIT: NECESSARY CLARIFICATIONS REGARDING TIM'S PRESS RELEASE ON THE MILAN COURT ORDER
Milan, July 13, 2026 - With reference to the press release issued by TIM today, INWIT deems it appropriate to clarify that it is incorrect to state that the Court has "confirmed the legitimacy of the withdrawal from the MSA".
The order is indeed part of a preliminary precautionary phase, and the judge merely noted that, at present, the requirement of periculum in mora has not been proven. As expressly acknowledged by the Judge himself, the central issues of the dispute – and specifically the validity of INWIT's exercise of the option in 2022 and TIM's subsequent termination – require an assessment that can only be carried out in the merits trial.
The central issue of the interpretation of the contract and the legitimate exercise of the termination remains undecided and has been expressly deferred to the full cognisance proceedings.
