INWIT acknowledges the Court of Milan's ruling in the interim proceedings brought against TIM and announces the start of an ordinary trial
Milan, July 13, 2026 - Infrastrutture Wireless Italiane S.p.A. (“INWIT”) acknowledges the ruling issued by the Court of Milan on July 11, 2026, whereby the Judge dismissed the request for interim measures filed by INWIT, ruling that, at present, the requirement of urgency (the so-called periculum in mora ) necessary for the adoption of said interim measures is not met.
INWIT points out that the ruling did not enter into the correct interpretation of the contractual clauses under dispute, nor on the duration of the MSA. The Court itself held that such matters must be examined under an ordinary trial to discuss the merits of the case , which INWIT will start without delay, after having also assessed, with its legal advisors, the opportunity to file an appeal against the aforementioned ruling .
The Company confirms the validity of the exercise of the option right carried out in 2022 and the subsequent extension of the duration of the MSA to 2038 and is confident that it can undoubtedly demonstrate this in the forthcoming ordinary trial.
